Order Respecting Occupancy Issued for 38 Main Street East – November 6, 2026

Multi-storey stone building

Work to stabilize the building at 38 Main Street East was completed in May 2025. At that time, an Unsafe Order remained in effect, requiring the property owner to submit a plan to the Municipality’s Chief Building Official (CBO) outlining how they would address any issues with the remainder of the building.

Since then, the property owner has not complied with the order, and no remediation plan has been submitted to the CBO.

Under the authority of the Ontario Building Code Act, the CBO retained a professional architect and engineer to complete a full assessment of the building. The final reports will be released publicly in the coming weeks.

Based on these assessments, the building has been found unsafe for occupancy. As a result, the CBO has issued an Order Respecting Occupancy for the entire building. This order requires any residents of the building to vacate by 12:00 noon, November 12, 2026

Additional orders will be issued to the property owner in the future as the Municipality continues to address outstanding building safety concerns.

The Municipality is aware that the property is currently listed for sale. While the Municipality has norole in the sale of private property, all orders issued on the property are registered on title and will remain the responsibility of any future owner.
