Heritage Week - "Did You Know?" - The Heritage Act - February 16, 2026

Each February, the Ontario Heritage Trust invites Ontarians to participate in Heritage Week to celebrate heritage in all its forms (cultural and natural, architectural, archaeological, and collections), and its diverse traditions and cultural expressions. In 1985, the Ontario government proclaimed the third week in February as Ontario Heritage Week.
Many municipalities use Heritage Week to promote awareness of heritage resources within their communities and to honour the heritage property owners, organizations and volunteers who have worked to protect Ontario’s irreplaceable heritage resources.
Today’s article is on the Ontario Heritage Act and heritage register.
The Ontario Heritage Act provides a framework for the conservation of properties in Ontario that have cultural heritage value or interest. Proclaimed in 1975, the Ontario Heritage Act enables municipalities to:

Establish a Municipal Heritage Committee,
-
Establish a municipal register of properties that may have heritage value and could be designated,
-
Designate individual properties of cultural heritage value or interest,
-
Designate Heritage Conservation Districts,
-
Protect properties using heritage conservation easements,
-
Provide financial incentives for heritage properties such as grants, and
-
Establish heritage maintenance standards for important heritage properties.
The Ontario Heritage Act was recently changed by the Province through the More Homes Built Faster Act, 2022 (Bill 23).
Key changes to the Act include:

How municipalities manage and update listed heritage properties, introducing a time limit of no more than two years for properties to remain on the heritage register.

When municipalities can issue a Notice of Intention to Designate a property.

Increasing the number of “criteria” required to be met to designate a heritage property, and
-
How municipalities create and manage Heritage Conservation Districts.
The municipality is currently reviewing the heritage registry to determine—based on established criteria—which properties should remain listed, and which should be removed, before the deadline of January 1, 2027.
