DAYCARE BY-LAW NO. 02-104
BEING a by-law to authorize the operation of a Day Care Centre within the meanings of the regulations under The Day Nurseries Act.
WHEREAS pursuant to Section 3(1) of the Day Nurseries Act, R.S.O. 1990, c. D.2 as amended, the council of a municipality may by by-law provide for the establishment of day nurseries;
AND WHEREAS in accordance with Section 15 of the Restructuring Order which states that モall by-laws and resolutions of the former municipalities and their local boards shall become the by-laws and resolutions of the new Town and its local boards and shall remain in effect in the areas of the former municipalities for five years, or until amended or repealed by the Council or Board of the new Townヤ;
AND WHEREAS the former Town of Almonte passed By-law 32-1994 and the Council of the Corporation of the Town of Mississippi Mills wishes to confirm the same By-law;
NOW THEREFORE the Council of the Corporation of the Town of Mississippi Mills hereby enacts as follows:
1. In this by-law, unless the context otherwise requires,
a) モCentreヤ means the Almonte Day Care Centre; b) モCommitteeヤ means the Almonte Day Care Advisory Committee; c) モCouncilヤ means the Council of the Corporation of the Town of Mississippi Mills; d) モTownヤ means the Corporation of the Town of Mississippi Mills.
2. A Day Care Centre for the Town of Mississippi Mills, to be known as the Almonte Day Care Centre is hereby established for the residents of the Town.
3. The Almonte Day Care Centre shall be managed and administered by Council and assisted by a Committee known as モThe Almonte Day Care Advisory Committeeヤ.
4. The Committee shall be composed of seven (7) members, of whom at least one is a member of Council. The members of the Committee shall be appointed by Council. No member of the committee shall be a paid employee of the Almonte Day Care Centre.
5. a) The Committee members shall be appointed by Council. b) The term of office for members shall be a maximum of five (5) consecutive years. Members may be reappointed to the Committee after two years following their five-year term. c) When a member resigns from the Committee before the expiration of his/her term, Council may appoint another eligible person for the unexpired portion of that term. d) If a Committee member fails to attend three (3) consecutive meetings of the Committee without reason, his/her position shall be deemed to be vacant. e) The Committee shall elect, annually, a Chairperson and such other officers as may be required from its members. f) The Committee shall hold regular meetings each month except the month of July at the Day Care Centre and shall forward to Council the minutes of said meetings. g) The Committee shall forward to Council the monthly financial statements of the Committee. h) The Chairperson may call special meetings of the Committee, to deal with specific duties of the Committee as he/she deems necessary. i) At any meeting of the Committee, a quorum shall consist of four (4) members of the Committee.
6. The Committee shall:
a) Establish and enforce all policies, rules and regulations relating to the Almonte Day Centre Centre. All such policies, rules and regulations shall be subject to the approval of Council. b) Ensure the existence of a day care program in accordance with the Day Nurseries Act. c) Ensure that the citizens of the Town are made aware of the services and opportunities provided by the Centre, d) Provide the necessary liaison and coordination between the Centre and other health, welfare and educational organizations. e) Submit and interpret to Council on or before the first day of February each year, a detailed estimate of the budget requirements for the current year.
7. The Committee may solicit and receive gifts or bequests of money and services to be applied to the benefit of the Centre.
8. Council shall appoint a properly trained and qualified Director for the Centre and qualified staff as required to ensure the proper operation of the Centre
9. In carrying out the provisions of this by-law, the Committee shall at all times be the agent of the Town and while acting bona fide within the limits of the authority of this by-law neither the Committee nor any member thereof shall incur any liability by reason of anything done or left undone by the Committee, provided however, that nothing in this paragraph contained shall authorize or empower the Committee to incur any debt, liability or obligation for which the Town shall become liable without having previously obtained the approval of Council.
10. By-law 32-1994 of the former Town of Almonte and any other by-law or parts of by-laws inconsistent with the provisions of this by-law are hereby repealed.
11. This by-law shall come into effect on the day of its passing.
